Welcome to CJ's Dog Training ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website https://www.cjsdogtraining.org (the "Site"), any related services (collectively, the "Services"), and any communications or interactions with us. By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Site or Services.

1. Eligibility

1.1 Age Requirement

By using this website and our services, you agree that:

  • You must be at least 18 years old (or the age of majority in your state or country) to use our services, book appointments, or enter into any agreement with us.
  • If you are under 18, you may only use our services under the direct supervision of a parent or legal guardian who agrees to these Terms on your behalf.
  • By accessing this website, you confirm that you have the legal capacity to enter into binding contracts.
  • You also confirm that all information you provide to us is accurate, current, and complete, and that you will update it if any changes occur.
  • We reserve the right to refuse service, terminate accounts, or cancel bookings if we believe that a user does not meet these eligibility requirements or has provided false or misleading information.

1.2 Location

Our Services are operated from Angleton, Texas, in the United States. If you access or use our Site outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

2. Services Overview

2.1 Dog Training Services

We provide dog training, board and train, group classes, and related services. Any specific outcomes mentioned on our Site or in promotional materials are provided for illustrative purposes only. Individual results may vary, and you acknowledge that dog training depends on various factors, including the dog's temperament, health, environment, and your participation.

2.2 No Veterinary Advice

Our Services are not intended to replace veterinary advice. For health or medical concerns regarding your pet, always consult a qualified veterinarian.

3. Pet Requirements & Owner Responsibilities

3.1 Owner/Guardian

You represent that you are the owner and/or authorized guardian of your pet and are fully authorized to enter this agreement.

3.2 Pet Requirements

You represent that your pet meets all of the following requirements:

  • Is four months of age or older
  • Is current on all required vaccinations
  • Is on a monthly flea and tick preventative medication
  • Has been in good health for the last 30 days prior to check-in
  • Has a completed Dog Profile on file
  • Will enter and exit the facility on a leash

3.3 Health Disclosure

You represent that your pet has not had any contagious illnesses for 30 days prior to check-in. You understand that our employees are not veterinarians and cannot diagnose or detect illnesses. You agree to assume all risk associated with the administration of medication during your pet's stay. Vaccines do not protect against all contagious illnesses.

3.4 Duty to Disclose

You agree to disclose and continue to disclose any and all medical conditions, personality concerns, or behaviors that may affect, limit, or prevent your pet's ability to participate in our services.

3.5 Accurate Information

You agree to provide accurate, current, and complete information as prompted by our booking forms or any other forms on our Site.

3.6 Compliance with Laws

You agree to comply with all applicable laws and regulations when using our Site and Services.

3.7 Prohibited Conduct

You must not:

  • Use the Site or Services in any manner that could disrupt, interfere with, or adversely affect other users
  • Upload or transmit any harmful code (viruses, malware, etc.)
  • Harass, bully, or defame any individual or entity
  • Attempt to gain unauthorized access to our systems or data

4. Health, Safety & Liability

4.1 Fleas and Ticks

If any fleas or ticks are discovered on your pet during check-in or at any time during their stay, we may administer a flea bath and flea spot treatment at your expense.

4.2 Veterinary Care

You authorize CJ's Dog Training to obtain veterinary medical treatment for your pet if, in our sole discretion, the pet appears ill, injured, or exhibits behavior suggesting medical treatment is needed. This may require transportation. You grant us full authority to make medical decisions during your pet's stay and agree to be fully responsible for all associated costs.

4.3 Assumption of Risk

You agree that you are assuming all risk of illness, disease, harm, or injury to your pet by allowing participation in activities at our facility. If your pet is injured by another pet, you release CJ's Dog Training, its owners, employees, and agents from all liability. If your pet bites a human or pet, we may contact the appropriate authorities.

4.4 Group Training & Play

CJ's Dog Training utilizes group training and structured play environments. Dogs interact with their mouth and paws, which can result in minor nicks and scratches. While we provide reasonable care and supervision, these may not always be noticed before departure.

4.5 Transportation

If your pet is transported to or from our facility by our employees or agents, you agree to hold us harmless in the event of injury or accident during transportation.

5. Booking, Payments & Cancellations

5.1 Reservations

Confirmed reservations are required for board and train and other multi-day programs. There is a three (3) night minimum for all board and train reservations during peak/holiday periods (some periods may require only a 2-night minimum, contact us for details). For extending stays, balance must be paid in full prior to extension.

5.2 Payment Terms

All fees are in U.S. dollars unless otherwise specified. You agree to pay all charges and fees incurred in connection with your bookings. Payment is due at the time of pickup with a credit card or cash. You give express permission for us to charge any credit card on file for unpaid fees, services, or products.

5.3 Training Rescheduling

Any late, missed, or rescheduled training appointment will result in the full charge of the expected service. Trainers are compensated for their time.

5.4 Early Departure

Once a pet's stay has begun, you are responsible for payment of all days reserved, regardless of picking your pet up prior to the scheduled departure date.

5.5 Refunds

Any refund or cancellation policies will be stated on our Site or in your service agreement. We reserve the right to issue refunds at our sole discretion, in accordance with applicable law.

6. Abandonment

If your pet is not picked up within 14 calendar days after the scheduled departure date, your pet shall be deemed "abandoned." We will, at our sole discretion, try to re-home your pet or relinquish your pet to a legal shelter. You may be unable to retrieve your pet and will have no recourse against us. You will still be responsible for all unpaid charges.

7. Personal Property

CJ's Dog Training is not responsible for any lost, stolen, or damaged personal property belonging to your dog or you. Your dog's collar may be removed during training or play activities to prevent injury, including flea collars. We strongly recommend GPS collars are removed prior to entering the facility, we are not liable for lost GPS collars.

8. Photo & Video Release

You agree to allow us to use your pet's name and any images or videos taken during their stay, in any form or format, for use in any media, marketing, advertising, or promotional materials.

9. Intellectual Property

9.1 Our Content

All content on our Site, such as text, graphics, logos, images, videos, and software, is owned or licensed by CJ's Dog Training and is protected by intellectual property laws. You may not reproduce, redistribute, or create derivative works from our content without our explicit written permission.

9.2 User-Generated Content

If our Site allows for user-generated content (e.g., testimonials, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.

10. Disclaimers

Our Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third-party sites. Your use of such sites is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, CJ's Dog Training, its owners, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) our Site or Services.

12. Indemnification

You agree to defend, indemnify, and hold harmless CJ's Dog Training and its affiliates, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses arising out of your use of our Site or Services, your violation of these Terms, or your violation of any rights of any other person or entity.

13. Refusal & Termination of Service

CJ's Dog Training reserves the right to deny admittance to any pet for any reason, at any time. We reserve the right to terminate or suspend your access to our Site or Services at any time, without prior notice, for any reason, including breach of these Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of Texas. Any legal action arising out of these Terms shall be instituted exclusively in the state or federal courts located in Brazoria County, Texas.

15. Modifications

We may update these Terms from time to time. If we make significant changes, we will provide notice by posting a prominent notice on our Site. Your continued use of our Site or Services after any changes indicates your acceptance of the revised Terms.

16. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CJ's Dog Training regarding your use of our Site and Services.
  • Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect any remaining provisions.
  • No Waiver: The failure to enforce any right or provision shall not constitute a waiver of such right or provision.

17. SMS/Text Messaging Terms

CJ's Dog Training offers SMS/text messaging to provide booking confirmations, appointment reminders, promotional offers, and updates related to our dog training services.

You can cancel the SMS service at any time. Just text "STOP" to (832) 862-8783. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
